Please read these terms carefully before using the Platform. They define your rights and responsibilities when using Pharmble.

Terms of Use

These Terms of Use ("Terms") govern your access to the Pharmble platform, including our website, mobile application, and delivery services. By accessing or using the Platform, you agree to comply with and be bound by these Terms and applicable Indian laws.

Platform Role (Intermediary)

Pharmble is an technology platform operating as an intermediary under Section 79 of the Information Technology Act, 2000.

What we do: We facilitate the discovery of medicine availability by connecting users with independent licensed pharmacies. Pharmble is not an online pharmacy, does not own, manufacture, store, or sell any medicines, and does not dispense prescriptions directly. All commercial transactions are between you and the respective partner pharmacy.

Customer Responsibilities

As a user of the Platform, you agree and represent that:

  • You are at least 18 years of age and legally competent to contract.
  • You will provide accurate delivery addresses, valid payment details, and keep your contact number active for communication during the delivery window.
  • You will only request prescription medicines for which you have a genuine, legally compliant prescription.

Pharmacy Partner Responsibilities

Our independent partner pharmacies operate under valid retail drug licenses and are solely responsible for:

  • Dispensing authentic, un-expired medicines that match your order exactly.
  • Strict prescription validation by a registered pharmacist under the Drugs and Cosmetics Act, 1940 and Pharmacy Act, 1948.
  • Maintaining appropriate hygienic storage conditions before order handover.

Prescription (Rx) Medicines

Orders containing prescription-only Schedule H, H1, or X drugs will not be processed unless a valid prescription image is uploaded through the Platform.

The prescription must be issued by a registered medical practitioner (RMP) in India, contain the patient's name, doctor's registration details, stamp/signature, and date. The partner pharmacy reserves the right to reject orders if the prescription does not satisfy legal standards.

Order Cancellations

You may cancel your order at any time before it is marked as "Dispatched" by the partner pharmacy. Once dispatched, the delivery agent is en route, and cancellation is not allowed. Pharmble or partner pharmacies reserve the right to cancel orders due to non-availability, invalid prescriptions, or suspect transactions.

Refund Eligibility

Refund eligibility is restricted to instances of damaged packaging, incorrect strength/brand deliveries, or missing items. Any issues must be raised within 24 hours of delivery confirmation.

Refunds are subject to verification and collection of the unopened product by our delivery agent. For more details, consult our Refund Policy.

Limitation of Liability

Pharmble is a technology facilitator and does not guarantee the efficacy, quality, or safety of the medicines sold by independent pharmacies. We are not liable for any adverse drug reactions, side effects, or clinical negligence originating from the medicines dispensed.

To the maximum extent permitted under applicable law, Pharmble’s total liability for any claim arising out of your use of the Platform is strictly limited to the value of the order under dispute.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any legal action or dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
